	SERVICE AGREEMENT - Terms & Conditions 1. All information presented by eRehabCoach.com is for educational purposes only. The material is not intended to be a form of or a substitute for medical counselling. The site is intended to help you make informed decisions about your lifestyle and habits. Before subscribing to any of the information presented throughout the eRehabCoach.com Web Site, please consult with your own physician, healthcare practitioner or recovery professional. eRehabCoach.com reserves the right to refuse or cancel participation for any reason. Any images, names or situations are for demonstration purposes only and should not be associated with actual events or people. eRehabCoach.com makes no warranties as to the efficacy of its model; results vary with each case. eRehabCoach.com is a division of BrainBank Inc. 2. GENERAL TERMS AND CONDITIONS: You agree to: (a) maintain all equipment necessary for your access to and use of eRehabCoach.com; (b) maintain the security of your user identification, password and other confidential information relating to your eRehabCoach.com account; (c) be responsible for all charges resulting from use of your eRehabCoach.com account, including unauthorized use prior to your notifying eRehabCoach.com of such unauthorized use and taking steps to prevent its further occurrence by changing your password; and (d) updating your personal information, including e-mail address. 3. PARTICIPATION TERM: The term of the eRehabCoach.com participation is twelve (12) weeks. With the exception of special offers, the Initial Participation Term ("IPT") is four (4) weeks. Unless specified otherwise on this Web Site, after the IPT, each participation automatically goes to term and participants are financially responsible for all associated renewal fees, unless eligible for free use or until notice of cancellation is received by eRehabCoach.com. 4. CANCELLATION & REFUND: After the IPT (first 4 weeks), a participant may cancel anytime and receive a full refund of any unused portion of their participation fees. Cancellations are not retroactive; therefore, if a participant cancels after the participation week has begun, the participant will not be entitled to a refund for that participation week. Cancellations do not become effective until the starting date of the participant’s next participation week. After the IPT, a participation week begins on the calendar day (e.g., Monday) when a participant subscribes to the eRehabCoach.com and concludes on the day before that calendar date (e.g., Sunday) the following week. A participation month begins on the calendar date (e.g., December 15th) when a participant subscribes to the eRehabCoach.com and concludes on the day before that calendar date (e.g., January 14th) the following month. A participant may cancel as follows: o By clicking on the Cancel option in My Account and following instructions o By email: send an email to cancellation@eRehabCoach.com indicating within the body of the message your intent to cancel. Be sure to include your user name. Please note that eRehabCoach.com will not accept or open email communications with attachments o By mail: send a brief letter, including your user name and email address used for payment confirmation, and send via Certified Mail it to: eRehabCoach.com 475 Dumont, Suite 202 Dorval, Quebec H9S 5W2 CANADA Attention: Participant Services 5. WAIVER, RELEASE AND LIMITATION OF LIABILITY: You agree that neither eRehabCoach.com, nor its affiliates, subsidiaries, officers, directors, employees, agents, consultants or information providers or suppliers, shall have any liability to you under any theory of liability or indemnity in connection with your use of the model established by eRehabCoach.com,. You hereby release and forever waive any and all claims you may have against eRehabCoach.com, its officers, directors, employees, agents, consultants, information providers or suppliers for losses or damages you sustain in connection with your use of the model established by eRehabCoach.com. eRehabCoach.com shall have no liability to you for any injuries, personal or otherwise, that you may suffer. 6. Notwithstanding the foregoing paragraph, the total liability of eRehabCoach.com, and its officers, directors, employees, agents, consultants, information providers and suppliers, if any, for losses or damages shall not exceed the fees paid by you for the particular information or service provided. All other damages, direct or indirect, special, incidental, consequential or punitive arising from any use of the information or other parts of eRehabCoach.com, are hereby excluded even if eRehabCoach.com or its officers, directors, employees, agents, consultants, information providers or suppliers have been advised of the possibility of such damages. Void where prohibited by law. Any action with respect to this agreement shall be taken or brought exclusively in the Quebec courts in the judicial district of Montreal. 7. NOTICE: eRehabCoach.com may deliver notice to you under this Agreement by means of electronic mail or a general notice on eRehabCoach.com. You may give notice to eRehabCoach.com at any time via electronic mail to info@eRehabCoach.com or by letter delivered by Certified Mail or overnight courier to the following address: eRehabCoach.com 475 Dumont, Suite 202 Dorval, Québec H9S 5W2 CANADA (514) 636-5141 8. When paying through Moneris, please note that charges will appear on your statement as BrainBank Inc. 9. This agreement is governed by the laws of the Province of Quebec and any litigation arising there under shall be brought exclusively before the courts of the district of Montreal, Province of Quebec. 12. There may be some mobile & SMS providers who do not offer compatibility with eRehabCoach. Known providers which do not currently support SMS delivery: o Bell Mobilty - Canada o Solo Mobile - Canada
